No owner or person in charge of property shall cause or permit any nuisance affecting public safety and welfare. The following are nuisances affecting public safety and welfare and may be abated as provided in this chapter:

(1) Any abandoned, discarded, or unattended icebox, refrigerator, or other container with a compartment of more than one and one-half cubic feet capacity that cannot be easily opened from the inside.

(2) Storing, or permitting to be stored, vehicles, recreational vehicles, boats, or any type of trailer for more than seventy-two (72) hours in any City right-of-way.

(3) Storing, or permitting to be stored, any vehicle, recreational vehicle, boat, or any type of trailer with an expired registration/license tag or any discarded vehicle (or portion thereof) on any private property unless completely enclosed within a building, unless it is not visible from any public right-of-way, or unless it is stored on the property of a business enterprise lawfully conducted within the City.

(4) Vegetation that is a hazard to pedestrian or vehicular use of any public right-of-way, by obstructing passage or vision. The hazards include, without limitation, the following:

(a) Vegetation that encroaches upon or overhangs a pedestrian way or parking strip or encroaches upon or overhangs a public right-of-way;

(b) Vegetation that obstructs motorist or pedestrian view of traffic signs and signals, streetlights, street name signs, or other safety fixtures or markings placed in the public right-of-way;

(c) Vegetation that is an obstruction to access or use of any public right-of-way or any improvements in the public right-of-way.

(5) Any accumulation of dry vegetation (including but not limited to grasses, weeds, shrubs, etc.) that presents a risk of fire or combustion. Lots less than one acre in size must be completely free of dry vegetation and lots greater than one acre must maintain a fire break around the exterior of the property of at least 20 feet.

(6) Noxious vegetation on public or private property. Noxious vegetation includes:

(a) All noxious weeds as defined by the current County noxious weeds list;

(b) Vegetation with disease or infection susceptible to spread; and

(c) Any dead or dying vegetation that presents a fire or fall hazard.

(7) The storage of ten (10) or more used tires, unless the tires are used for agricultural or landscaping purposes, stored on the property of a legally operated business that normally deals in tires, or if the tires are completely enclosed within a building and do not otherwise constitute a fire hazard or health hazard.
